Terms and conditions

TERMS AND CONDITIONS OF THE VIKTORIA PRAHA ONLINE STORE
INTRODUCTORY PROVISIONS AND IDENTIFICATION OF THE SELLER

These terms and conditions (hereinafter referred to as “terms and conditions”) of the Viktoria Praha online store, contact e-mail: info@viktoriapraha.com (hereinafter referred to as the “seller”), govern, in accordance with the provisions of Section 1751 (1) of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter referred to as the “Civil Code”), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract (hereinafter referred to as the “purchase contract”) concluded between the seller and another person (hereinafter referred to as the “buyer” or “consumer”) via the seller’s online store.
The terms and conditions apply primarily to the purchase of women's clothing, fashion, and accessories by buyers with their registered office or place of residence in the territory of the Czech Republic.

ARTICLE 1 – TERMS OF THE ONLINE STORE AND LEGAL CAPACITY
1. By entering the e-shop website and placing an order, the buyer confirms that they are at least 18 years of age (fully legally competent) or have the consent of their legal guardian.
2. The buyer must not use the purchased clothing, accessories, or services for illegal purposes or in violation of the laws of their jurisdiction, including copyright and intellectual property rights.
3. It is strictly forbidden to insert malicious code, computer viruses, or otherwise disrupt the technological infrastructure of the e-shop into the website system.
4. Violation of any of these rules entitles the seller to immediately cancel the user account or refuse to process the order.
ARTICLE 2 – GENERAL PROVISIONS AND PAYMENT SECURITY
1. The seller reserves the right to refuse to provide services to anyone for legitimate reasons (e.g., previous repeated unjustified non-acceptance of shipments, misuse of payment instruments).
2. The buyer acknowledges that technical order data may be transmitted in encrypted form across networks necessary for connection with servers and logistics partners.
3. Payment card security: Payment card data is processed exclusively through certified banking payment gateways secured by SSL/TLS encryption in accordance with the international PCI-DSS security standard. The seller does not store complete customer payment card data on its servers.
4. Without the seller's prior written consent, it is prohibited to reproduce, copy, download catalog photos, or commercially exploit any part of the e-shop.
ARTICLE 3 – ACCURACY OF INFORMATION AND WOMEN'S CLOTHING SIZE CHART
1. All product descriptions, textile materials used, and dimension charts are provided with maximum care. Due to the nature of textile production and the elasticity of fabrics, the actual dimensions of the finished garment may deviate within the usual manufacturing tolerance (typically 1–2 cm), which is not considered a product defect.
2. It is strongly recommended that the buyer compares their body measurements with the Size Chart (Tabulka velikostí) provided on the specific product page before placing an order.
3. In case of any questions regarding the cut, composition, or size, customer support is available to the buyer before making a purchase.
ARTICLE 4 – PRICES, CONCLUSION OF THE PURCHASE CONTRACT, AND WARRANTY RIGHTS
1. All prices presented in the online store are stated in Czech crowns (CZK) including Value Added Tax (VAT) at the statutory rate and all statutory fees. Shipping costs are always clearly calculated before an order is placed.
2. Conclusion of the contract: The presentation of clothing in the e-shop interface is for information purposes and does not constitute a binding offer by the seller to conclude a contract (Section 1732 (2) of the Civil Code). The buyer makes a binding offer to conclude a purchase contract by clicking on a button with a clear indication of the obligation to pay (e.g., "Order with obligation to pay" or "Complete purchase and pay").
3. The purchase contract is concluded at the moment the seller delivers written confirmation of order acceptance to the buyer's e-mail address, together with a summary and the text of these terms and conditions.
4. Statutory warranty: The sold consumer goods are subject to statutory liability for defects for a period of 24 months from the receipt of the goods by the buyer.
ARTICLE 5 – WOMEN'S FASHION, COLOR DISPLAY, AND INTERNATIONAL SHIPPING
1. The offer of clothing and accessories may be limited by the supplier's stock.
2. Color display: Photos of goods on the website correspond to reality as faithfully as possible. However, due to different color rendering, calibration, and resolution of various monitors and mobile device displays, the seller cannot guarantee 100% agreement of the color shade on the screen with reality.
3. Method and time of delivery: Goods are shipped via specialized international logistics partners and distribution centers. The estimated standard delivery time to the Czech Republic is typically 7 to 15 business days from the dispatch of the order. After the shipment is sent, the buyer will receive an online tracking code via e-mail.
4. VAT and customs duties: Prices for goods for end consumers in the Czech Republic are final and include VAT (under the IOSS regime). Customers in the Czech Republic do not pay any hidden customs fees or additional taxes upon standard delivery of the shipment.
ARTICLE 6 – BILLING DATA AND DELIVERY ADDRESS IN THE CR
1. When ordering goods, the buyer is obliged to provide correct and truthful contact and delivery information: name and surname, complete delivery address in the territory of the Czech Republic, valid postal code, and a functional phone number with the +420 prefix for courier purposes (e.g., Zásilkovna, Balíkovna, PPL, DPD, or Czech Post).
2. The seller is not responsible for any delay or non-delivery of the shipment resulting from the buyer providing an incorrect, incomplete, or non-existent address.
ARTICLE 7 – OPTIONAL THIRD-PARTY TOOLS
1. The e-shop may offer buyers additional tools (e.g., size assistants, virtual measurement converters, or fit recommendation apps). These tools are provided without any warranties solely to facilitate the selection process.
2. The decision on the final size choice based on these tools belongs exclusively to the buyer.
ARTICLE 8 – LINKS TO THIRD-PARTY WEBSITES
1. The online store may link to profiles on social networks (Instagram, Facebook, TikTok, Pinterest) or external services.
2. The seller is not responsible for the privacy policies or content on these external websites.
ARTICLE 9 – USER REVIEWS AND OMNIBUS DIRECTIVE
1. In accordance with the Consumer Protection Act and the European Omnibus Directive, the seller ensures that all clothing ratings and reviews published on the website come only from actual customers who have demonstrably purchased the product (so-called verified reviews).
2. The seller is entitled not to publish or to delete reviews containing vulgar content, insults, unauthorized third-party advertising, or texts violating the laws of the Czech Republic.
ARTICLE 10 – PERSONAL DATA PROTECTION (GDPR)
1. The protection of the buyer's personal data is ensured in full compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on the processing of personal data.
2. Personal data are processed exclusively for the purpose of executing the purchase contract, processing the order, communicating with the customer, and fulfilling statutory accounting obligations. The supervisory authority in the Czech Republic is the Office for Personal Data Protection (ÚOOÚ). Detailed information is contained in the separate Privacy Policy document on the website.
ARTICLE 11 – ERRORS AND OBVIOUS MISTAKES IN PRICE
1. In the event that a clearly incorrect price is displayed for goods due to a system or technical error (for example, a women's coat worth 1,800 CZK is mistakenly displayed for 18 CZK), the purchase contract is not validly concluded, even if an automatic order confirmation is sent, as the seller's intent to sell the goods at this clearly nonsensical price is missing.
2. In such a case, the seller will inform the buyer of the error without undue delay and return all payments received to the buyer.
ARTICLE 12 – PROHIBITED USES
The buyer agrees not to use the e-shop website for:
 Violating Czech and EU legal regulations or fraudulent activities;
 Damaging the reputation and intellectual property rights of the seller;
 Spreading unsolicited commercial communications (spam), malicious code, and viruses;
Unauthorized automated data scraping from the product catalog.
ARTICLE 13 – LIABILITY FOR DEFECTS (STATUTORY WARRANTY OF 24 MONTHS) AND COMPLAINT PROCEDURE
1. The rights and obligations of the parties regarding rights arising from defective performance are governed by the relevant legal regulations, in particular Sections 1914 to 1925, 2099 to 2117, and 2161 to 2174b of the Civil Code and Act No. 634/1992 Coll., on consumer protection.
2. Warranty period: The consumer has the right to exercise the right from a defect that occurs in consumer goods within twenty-four (24) months from receipt.
3. Burden of proof: If a defect manifests itself during the first 1 year (12 months) from receipt, it is presumed that the goods were already defective upon receipt, unless the nature of the item or defect excludes this (Section 2161 (5) of the Civil Code).
4. What constitutes a defect: Manufacturing defects of clothing (e.g., torn seams from production, non-functional zipper, material defects, demonstrable color bleeding when washing instructions are followed) are considered defects. A defect consisting of irreparable damage gives rise to the right to an exchange for a new piece or withdrawal from the contract with a refund.
5. Exclusions: The warranty does not cover normal wear and tear caused by usual wearing and washing of the garment, mechanical damage (tearing of the fabric on a sharp object), or damage caused by failure to follow the care symbols on the sewn-in garment label.
6. Deadline for processing: The complaint, including the removal of the defect, must be settled and the consumer notified no later than 30 days from the day of its filing (Section 19 of the Consumer Protection Act).
ARTICLE 14 – LIMITATION OF LIABILITY
To the extent permitted by applicable law and without prejudice to the consumer's mandatory rights to damages under Czech law, the total liability of the seller for direct damages is limited to the amount of the purchase price paid for the goods in question.
ARTICLE 15 – DAMAGES
The buyer is obliged to compensate the seller for damages incurred due to intentional misuse of services, entry of non-existent or stolen payment details, or unauthorized disruption of the e-shop operation.
ARTICLE 16 – WITHDRAWAL FROM THE CONTRACT WITHIN 14 DAYS AND RULES FOR RETURNING WOMEN'S CLOTHING
1. In accordance with Section 1829 (1) of the Civil Code, the consumer has the right to withdraw from the purchase contract without giving any reason within a period of 14 days from the date of receipt of the goods.
2. Conditions for trying on clothing: The customer has the full right to try on the delivered garment at home to determine the correct size, cut, and properties, in the same manner as would be permitted in a classic fitting room of a brick-and-mortar store.
3. Condition of returned goods: The garment must be returned clean, unworn beyond trying on, unwashed, free of traces of make-up, body lotions, or deodorant, free of the smell of perfume or cigarette smoke, and if possible, with original tags attached.
4. Reduction in the value of goods (Section 1833 of the Civil Code): If the buyer returns goods that are damaged, washed, or show signs of normal wear beyond the scope of necessary trying on, they are liable to the seller for the reduction in the value of the goods. In such a case, the seller is entitled to offset the claim for compensation for reduced value against the returned purchase price.
5. Hygienic exception to withdrawal (Section 1837 (g) of the Civil Code): The right to withdraw from the contract cannot be exercised for hygienic and health reasons for goods in sealed packaging which the customer has removed from this packaging (specifically: panties, adhesive silicone bras, hosiery from opened packaging, or women's swimwear with the protective hygiene strip removed).
6. Refund: The seller will return all received funds, including the cheapest method of standard delivery, within 14 days of withdrawal from the contract, using the same payment method. However, the seller is not obliged to refund the money before the consumer hands over the goods or proves that they have sent the goods back.
ARTICLE 17 – SEVERABILITY OF PROVISIONS
If any provision of these terms and conditions is invalid or ineffective, the invalid provision shall be replaced by a provision whose meaning is as close as possible to the invalid provision. The invalidity of one provision shall not affect the validity of the other provisions of the terms and conditions.
ARTICLE 18 – ENTIRE AGREEMENT
These terms and conditions, the order confirmation, and the Privacy Policy document constitute the entire and complete agreement between the buyer and the seller. The purchase contract is concluded in the Czech language.
ARTICLE 19 – GOVERNING LAW AND OUT-OF-COURT DISPUTE RESOLUTION (ČOI / ADR)
1. These terms and conditions and all relations arising from the purchase contract are governed by the law of the country of the seller's registered office, while fully respecting the mandatory provisions of Czech consumer protection law in accordance with Article 6 (2) of the Rome I Regulation.
2. Out-of-court resolution of consumer disputes (ADR): The following is substantively competent for the out-of-court resolution of consumer disputes arising from the purchase contract:
 Czech Trade Inspection Authority (ČOI)
 Central Inspectorate – ADR Department
 Address: Štěpánská 567/15, 120 00 Prague 2, Czech Republic
